Whereas the judge's decision is a verdict which imposes a sentence that has permanent legal force, but if the defendant or the public prosecutor refuses or object to the decision determined by the judge, the defendant and the public prosecutor can exercise their rights which are known in the Criminal Procedure Code as an attempt. law. Legal remedies are the right of the Defendant or Public Prosecutor not to accept the Court's decision in the form of resistance or appeal or cassation or the convict to submit a request for reconsideration in matters and according to methods regulated by law. The problem is what factors cause housewives to become entangled in criminal cases as drug dealers and the background for the Public Prosecutor to take legal action against case Number 40 / Pid.Sus / 2019 / PN Kbu. The approach to the problem in this study the writer uses a normative approach, namely by reading books, recording and quoting and using both laws and regulations as regulated in the Criminal Code (KUHP), the Criminal Procedure Code (KUHAP), as well as other laws and regulations that can support this research. The results of the study concluded that the factors causing housewives entangled in criminal cases as drug dealers, including economic hardship factors, perpetrator education factors, environmental factors, weak faith factors and low understanding of the law, while the background for the Public Prosecutor to Make Legal Efforts Appeal for Case Number 40 / Pid.Sus / 2019 / PN Kbu, because the Judge in determining his decision is based only on evidence and neglects most or all of the facts and legal considerations, the testimony of witnesses, the defendant's statement and the evidence presented in the trial.
